The Form I-9 for seasonal employees [Video]

Summer is quickly approaching, and that means US companies will, once again, hire seasonal employees to meet production and service demands.

As short-term seasonal employees return to their jobs, the completion of the Form I-9 for these temporary workers may cause employers confusion or uncertainty. Yet, not unlike any other employee,

temporary seasonal workers who are here for the summer also require completed I-9 forms.

When summer comes to an end, and your seasonal employees leave until the following June, their I-9s should not go with them. Instead, retain the forms, and when your summertime staff returns, treat them as rehires. 

When rehiring your seasonal worker, look closely at the existing Form I-9. If the rehire takes place within 3 years of the date of the initial execution of the employee's previous Form I-9, you may

either: complete a new Form I-9, or rely on the existing Form I-9.

After inspecting the I-9, if the employee's work authorization is still valid, simply update Block B in Section 3 with the date of rehire. However, if you determine that the employee's work authorization has

expired, you must reverify employment authorization in Block C of Section 3 of the previously completed Form I-9, or use page 2 of a new Form I-9 if Section 3 has already been used.
